The advertisement was deemed to be directed primarily toward elderly consumers. The advertisement was deemed to be misleading as it made claims that the product could have benefits in relation to cognitive function, memory, clear thinking, and related concerns in the context of age-related decline.
A complaint about the advertisement was recently upheld by the Complaints Resolution Panel. The panel found that the claims were unlawful, misleading and unverified and breached the Therapeutic Goods Advertising Code. The Panel therefore requested that we publish this retraction.
